Toward Performance-Based Emergency Planning for Small Modular Reactors: Regulatory Framework Considerations in Korea

Abstract: Korea's radiological emergency preparedness (EP) regulatory framework, codified under the Act on Promotion of Disaster Prevention and Emergency Preparedness at Nuclear Facilities, prescribes a fixed Emergency Planning Zone (EPZ) of 20–30 km modeled on large light-water reactor (LWR) assumptions rooted in the WASH-1400 probabilistic safety assessment. This prescriptive regime does not differentiate between facility types based on actual radiological hazard potential. As small modular reactors (SMRs) approach commercialization—with Korea's i-SMR targeting a construction permit application in 2028—regulators face increasing pressure to evaluate whether existing EP requirements remain technically justified for facilities with substantially reduced source terms and passive safety systems. This paper examines the identified regulatory mismatch from a conservative regulatory standpoint, acknowledging that while SMR safety characteristics are recognized in design certification, their full regulatory credit in EP has not yet been established. Drawing on comparative analysis of IAEA GSR Part 7, U.S. 10 CFR 50.33 (2023 revision), NRC Regulatory Guide 1.242, and Finland's STUK Y/2/2024, this study identifies three priority EP planning areas warranting regulatory review: (1) site-specific EPZ determination informed by a probabilistic analysis; (2) conditional exemption from evacuation time estimates and off-site emergency response facilities; and (3) introduction of technology-neutral safety performance indicators. The paper concludes with a proposed regulatory roadmap aligned with Korea's i-SMR licensing schedule, emphasizing that any transition from prescriptive to performance-based EP regulation must be grounded in verified PSA results, independent regulatory review, and explicit statutory authority.
